I just wanted to make sure I was correct about this. Our work week is from Sunday to Saturday and we normally work a 40 hour week, 8 hours per day from Monday through Friday. There was a holiday on Monday so I only worked 32 hours between Monday and Friday and was paid 8 hours for holiday. If I work 4 hours on Saturday of that same week, that would be at just straight pay and not overtime correct?

You have to physically work over 40 hours to get overtime pay correct?

You are correct. Overtime is based on time worked, not time paid.

So if i have overtime built up and take a much deserved vacation day within that pay period I will end up screwing myself out of the overtime pay :mad:

Can someone show me a legal document that states this :rolleyes:

Barring a bona fide contract that says otherwise, there are no circumstances in which an employer is required to pay overtime when you WORK less than 40 hours in a week. The law says you get overtime based on hours worked, not on hours paid.
