View Full Version : Late Receiving Payment

I am supposed to be paid every other Thursday. This Thusday, the checks that are mailed to our company, then given to us, did not arrive, nor did we receive them on Friday. Those with direct deposit did get theirs on Friday, though. The company did not inform us that receive checks we would not be getting paid on time.

At the end of the day, Friday, when I went to the owners asking for payment (which they never mentioned to anyone that the checks did not come in) they told me they could not give me my pay check and would give me a company check for the amount I needed, thus cutting me a company check for $200.00.

On that monday, no check arrived again, and once again, they did not care to tell us.

On tuesday, once again, the checks did not come in, and I told my supervisor that "I will not work until I am paid." and proceeded to go home (this was about 3:00 p.m.).

Wednesday morning, I was called and told that my pay check was ready and that I no longer had a job there.

This seems slightly fishy to me since my paycheck was 3 working days late.

Is there anything to be done about this in the state of Florida?

Just as an added not, people with direct deposit always got paid on Thursday (excusing this one time) while those of us who received checks got paid on Firday afternoons most of the time.

Thanks.

Nobody handled this right.

Your employers were legally wrong in not having your check ready for you. However, since they have since provided it, it's unlikely (especially in your state) that it would be worth filing a complaint.

In your state, if you had provided a written complaint to your supervisor and allowed them a reasonable time to investigate, and THEN they had fired you for complaining, you might have had some recourse. Since instead you refused to work until you were paid (though I can't say I blame you) and walked off the job, they were justified (and legal) in firing you.

Here is another question for you now. Like I said before, our paydays are on Thursday. Yesterday, in fact, would have been a pay day. Apparently, they put my final check in the mail to send to me yesterday (after the mail had run) so it would have not been picked up till today. Obviously, I will not be receiving it till Monday (if I am lucky) or Tuesday. Is this legal?

To the best of my knowledge, as long as they put it into the mail on the payday, they're legal.
