View Full Version : Think ovetime is incorrectly being paid. Help

My husband works in maintenance for a plant in SC. Since they are paid bi-weekly. Standard 40 hrs. totally 80 would be straight time. He hardly ever works simply 40, yet when he gets paid, on his checkstub is will read similar to this. This example is how his last check read: 90 reg. hrs. and 20 ot. hrs. The ot. hrs. was at time and half, but the 90 hrs. were straight time. He has to be on call via a pager for 2nd and 3rd shift and the weekend. There is a 50.00 pay for covering the weekend, plus the time in solving the problem. They say they don't pay or compensate for being on call for 2nd or 3rd shift through the week days, only weekends. It doesn't sound right or legal. He works first shift and is on call for second and thrid, so they are having all three shifts covers through the week, as well as the weekend.

Can they do this? They are a family owned business and the account over payroll is always looking to cut corners on the employees checks. Most workers won't challenge them about their monies in fear of being fired, then if you do, the accountant gives you so much run around you don't know whether to believe what he says or not.

Your husband does not need to be paid for the time he carries a pager, even the $50 that they are paying him.
