I live in Oregon. I worked at ( We'll call it Company X ) and I was in a training class for a Call center .
-It is a 7 week class and there are 16 students in this class. Upon graduation each graduate will be a full time employee.
-I had a female who flirted with me alot and I blew it off at first until she made this comment " Ummm If We werent in class you would be in so much trouble " I said Umm hey I dont know if you know this or not but I am married( I wasnt wearing my ring b/c it was being repaired but I KNOW I had talked about my wife and kids around her ) Ialso told her I was NOTok with her flirting and making comments like this to me. She said " Oh Okay its all good "
- So a weekend went by and there were 3 of the students who went to a bar and brought their spouses INCLUDING The accused Her name is Brittney. She also brought her spouse . She had a great relationship with her husband and hewas very nice ( SO IT SEEMED )
-Well on Monday she was following me everywhere and making little comments like " Oh YOU ARE SO HOT and I just want you so bad "
- I told her I didnt mess around onmy wife and to please leave it at that
- Later on that day she asked me if I would go with her after work and sit with her while she got some work done on her tatoo. I declined , she said she wanted to have sex with me i said " NO "
- She continued to be flirtatous and I was VERY UNCOMFORTABLE and after work I told a coworker that I was very uncomfortable and at that time I noticed her standing by my car .I was very nervous. Scott said " Dude , you should go tell someone. " I then said "No , Ill just go get in my car and take off "
- I went to my car and she asked me again if I would go with her , She said Well if you go Ill " Suck your MALE GENETALS . " I said " No "
- She proceeded to follow me after I drove away. I got scared she was going to follow me home andI would have a stalker situation on my hands. So When I noticed her gestering me to pull over I did (Only to get her off my butt )
- I told her I was very tired and even if I wanted to I couldnt due to me being so tired. She said " Well after we have fun I can just drive you home "
- I then got angry and said " DUDE , WHY DONTYOU JUST LEAVE ME ALONE " She sped off really angry
- I called in sick the next day to workout some financial matters and make a decision if I was going to file or quit my job
- So I Quit my job,the thought of being in a class with her again sickened me. I did NOT Call or show on Tuesday. Well 1 week went by and I made 2 attempts to get my job back without filing a suit ( ONLY B/CI KNEW I WOULD GET A DIFFERENT SHIFT AND DIFFERENT CLASS SO ID NEVER SEE HER AGAIN )
- Well I filed with HR on Wednesday and they started the investigation immediately. And the guy who I told i was uncomfortable was the first questioned and he toldthem that I did tell him about all of it and basically told them what I told them. He ALSO Told them that she had hit on him and made him feel uncomfortable until he introduced him to his wife.
- Now one more TIDBIT - She had went in to HR the day before I filed the claim telling them she was having mental " ISSUES " and was afraid she was gonna have to leave if she didnt get any help. They referred her to a crisis line.
This corporation is in the top 3 wireless telephone providers . I am sort of confident that it will be okay and they will do the right thing but they are interviewing way too many people. I feel that its unnecassary to interview the entire class. They even interviewed the instructor. I need some direction on what elseI should do.

ALL I ASKED THEM FOR IS WHAT I WOULD HAVE GOTTEN IF I WASNT HARRASSED AND THATS MY JOB BACK AND THATS IT....IF THEY FIND THAT THERE INDEED WAS A SEXUAL HARRASSING EVENT ARE THEY LIABLE TO REMEMPLOY ME AND RETURN ME TO FULL TIME POSITION OR ALLOW ME TO TAKE THE TRAINING OVER..?
This instance of me quitting has caused severe hardship and forced me to get public assistance ( Which I hate ) and energy assistance to pay my electric bill and my wifes car is 7 days from being reposessed because we dont have enough money to pay the car note. It was behind but I just paid 900.00 and need to pay 400.00 more to get it current

So what else should I do to cover my bases, Should I hire a lawyer ? Should I seek compensation or just try to get my job back ? PLEASE HELP ME

You have a complicated situation. Your problem is that you quit instead of going to HR to file a report, then went back to HR, filed a report and asked for your job back. So, it is a gray area whether or not you have to be rehired. The company cannot stop someone who is a sexual harasser if they do not know about it. Liability kicks in if they should have known about it and did not, or if they were told of it and then did not take steps for it to stop. The company acted once they knew of the situation. The lady had mental problems and was referred to help, likely an employee assistance benefit. After you made the sexual harassment report to them, they are investigating. And they are interviewing everyone to find out if this was so overt that they should have known about it, or if it was something that primarily impacted just you that they would not have known about unless it was reported. From what you are saying, there was no hostile work environment created that the company would have known about had you not reported it to them, which you did not until you had left. So I think any claim of sexual discrimination is weak. I recommend talking to an employment law attorney, and many attorneys offer free initial consultation. Even if I felt like it was an unlikely situation due to the fact that 98% of the sexuial harrassment cases are filed by females. There has to be some sort of way to be reconsidered as in a manner that I felt uncomfortable taking action.
I know of 3 people who got their jobs back even though they were a no call/ no show . I was devastated and have been suffering loss of sleep, headaches, and mood swings since it happened due to the heightened stress of this matter. I will more than likely hire a lawyer but I was just wanting to find out if I was just being impatient and not allowing due process. I dont want to screw up my ability to be rehired if i do not get my job back or ( IS THAT TOO LATE )

I still cannot say because if you had gone to report prior to quitting the job, I feel pretty sure you would still have a job. The company would have made an investigation and likely an accomodation for you. Since you quit first, they have to go back and see if it was really due to the sexual harassment. You may just want to call them and ask them if you are getting your job back, and if so, when am I starting again. I am not disputing that you suffered harassment, but for the company to be liable you need to be able to prove certain facts to make them liable, and I think you may have some problems with that given how this occurred, lack of witnesses and some of it happening outside of work.

Well , The HR department contacted me and said they found no cause in the Claim. I cant understand that especially when I have one witness who told them it happened to him. I contacted Civil Rights Division and they said that I have grounds for a claim against them and I also Hired a lawyer and they also feel that the girl was in the wrong.
