i have a question as who pays child support in south carolina? The man who signs the birth certificate or the biological father? The man who signed the birth certificate is not the biological father, but he was there for 4 months and then left. the medicade office signed child support papers on the one who signed the birth certificate because the baby has his last name. answers please. :confused:

As far as they know, the father on the birth certificate is the legal father. If there is another father, then paternity needs to be established on this real father and the original father removed from the birth certificate. Establishing paternity is governed by state statute. Typically, it will involve a blood test and adjudication by a court of paternity, and the removal or relinquishment of parental rights from the listed father.

well we had a test 4 months after he was born. and it wasnt his. but the real father is who knows where. i was told that if the man aknowledges that it is his child and waves the paternity test and signs the papers he is responsible. i read this on falseaccusiations.com. for the state of sc.and he has 60 days after he signs them to request a recession of his signature, if he dosent he is the father in the eyes of the law.

That sounds right. I do not know what else to tell you. If you do not find the real father to accept paternity, the state deems it in the best interest of the child to have a father that will accept responsibility, even if it is not the biological father.
