My friend got arrested for aggravated assault. She was driving home from work and a lady cut her off. She then flipped the lady off and cut her off too. The lady along with a witness followed my friend to her house and called the cops. The cops got their and heard the lady and the witnesses' story and arrested my friend for "aggravated assault". I went to the police department and managed to get her out. But she has to see a judge on Monday. The lady is saying that her back hurts but nothing happened to either cars. There was no contact between the cars whatsoever. She still says that my friend almost killed her and that her back hurts because her SUV swirled when my friend cut her off. Can anyone tell me if my friend is in trouble? If so, how deep? Or is there any way that she can be found not guilty by the judge? Please help. Thank you.

You need to go get a good criminal defense lawyer. This is a she said-she said thing. Your friend's points are not being heard. Maybe attorney- to prosecutor, it will be. This is something that ought to be able to go away.

Thanks for the info. Well, she didn't get a lawyer and the judge gave her a $20,000 bail bond. I had to bail her out with $2,000. Now she's free but we need to get a lawyer. What do you think will happen? I mean how serious can this be? At first, I thought this would be dismissed as a misdemenor or something but then when the sent her to county on a $20,000 bail I started to worry. I am still worried, what do you suggest or how much do you think the lawyer will charge for this?

I would say at least $500 for the lawyer, maybe more. BUt I see nothing aggravated because there is no imminent harm being done with a knife, gun, or beating, unless they argue the car is the aggravating cause. Also, there is a difference between road rage flipping someone a finger and intent to cause harm. The person may have already been injured and just making this up to try and get money or damages. There are many holes to the story. The intent is shaky and the aggravated part I do not get, but local counsel should be able to make a deal for dismissal or diversion.
