View Full Version : OT:One odd day or do real lawyers make house calls?

My door bell rang today, and standing there on my stoop was my new neighbour
who lives directly across the street, and another lady. The other lady
proceeds to tell me she has backed out of the neighbour's driveway and
broken my mailbox. Understand this is in broad daylight, and our street
certainly can not be considered narrow by any means.
The lady hands me her card, which states she is an attorney from Delray
Beach which is a good three hours drive south of us. Our neighbours are
apparently her clients.
When I stupidly asked her how in God's name she had managed to back over my
mailbox, she got very indignant and said well accidents happen. She then
said " well I could have just driven away and not told you about it".
Nice.....
Then she started to tell me just exactly what Dennis would need to do to
repair the post, and that it would not cost much to fix it. Bear in mind
Dennis has been through Radiation treatment for Prostate Cancer and he
really needs to come home from work and fix the mess that this woman made in
90degree heat.... My guess was she was on her cell phone or trying to
control the small child she had with her in the car.
So do real lawyers make house calls three hours away? Her business card
states that she handles "Bankruptcy, divorce, child custody and wills, child
support and Paternity, auto accidents, immigration, modifications, notary
services & more". I did a search on the Internet and did not get a hit on
her name or the name of her business, which has LLC tacked on at the end.
I am going to file a police report tomorrow only because of the attitude she
copped with me about the whole situation, and in case she develops amnesia
about stating she would pay to repair it....what a day.
Oh and the new neighbours, before they had even moved in, sent the kids to
my house wanting me to take the cat for two weeks.....and put my name on as
the emergency contact for their child at the school where I work without my
permission (even though they have relatives in the city).
Thanks for letting me vent. I haven't posted in quite some time.

I don't think it's that unusual for an attorney to visit a client
outside of the office for one reason or another. I do that sometimes,
when warranted. Sounds like she did the right thing to notify you about
the accident.

It could be that the attorney is a friend of the neighbor and
was called because the neighbor was fearful or just happened to be
there. If you want her credentials you can try finding her on:

When my daughter moved to Mississippi a
few months back she found her neighbors to be the same as you new one.
Very pushy and intrusive which is something we up north are not at all
accustomed to.

Fix the mailbox and send the bill to the neighbor and
a copy to the attorney. And then forget they live there.

Hmm, maybe I misread this. I thought it was the attorney who
backed in to the mailbox.

Laughing, I misread it. I read the neighbor did the deed
and arrived at the doorstep with her attorney. Second, third and fourth
reading has the attorney doing the deed. ;-) Time for dinner and raise
the blood sugar !!!!

Thanks for the opinions folks. It was a good day until the doorbell rang,
and it seems lately it's the new neighbours' fingers pushing the button...
Dennis is out right now trying to fix it in between the rolling thunder
storms. I guess the biggest thing that irked me is that she acted like she
was doing me a favour by admitting that she did it. It certainly wouldn't be
a decision for me if I had done something similar. I was taught you take
responsibility for your actions, and in my humble opinion when you handing
out a business card that states your profession as being a lawyer, you
should be doing your utmost to prove you are a responsible person.....don't
ya think??? :))
Good to hear from you Rete. I check the board just to keep up on things, but
don't see too many familiar names any more.

How would your neighbor know that?

Sound's like a "Jake of all trades and a master of none"! I'd find it a
little hard to believe that such a lawyer practices in that many areas
at once!

You should first try to resolve the problem amicably by getting an
estimate of a professional repair and asking if she's willing to pay the
damages. If you do resort to legal means it should be because you are
owed *not* because she "copped an attitude with you".

Doesn't sound totally unreasonable. What did you answer?

To add a little bit I would also follow up with a letter to the school
and cc the neighbors and retain a copy in your personal files. Somehow
things put in writing seem to carry more weight than a telephone
conversation. In the interest of avoiding an ongoing fued you my wish to
attempt to be diplomatic first. Maybe something along the lines of
telling the neighbors first that you are not comfortable as being their
emergency contact. Out of curiosity how did you find out that you were
put down as the emergency contact?

In regards to the Prostate Cancer, Dennis had IMRT radiation and Hormone
Therapy. Now we have to wait and see if it worked. He will have to have PSA
tests on a regular basis to track the results of his treatment.

When the neighbours want something, they send their children to my door.
I had come home from work one day, and the kids rang the bell to tell me
"Mummy wants to talk to you." So I went to speak to Mummy and that is when
she said " Do you mind if we put you down as our emergency contact for the
school?" I said " No I won't be; you have all sorts of family in town that
can do that for you." The next day I asked the school secretary to check,
and they had put me down the day they enrolled their son, which was the day
before they asked me about it.
The incident with the cat was just about the same kind of deal. These folks
took about a month to totally move in, so Robyn had been playing with the
kids. The kids showed up on my step on a Saturday night at about 7pm with
the cat. "My daddy says you take the cat." were the first words out of their
mouths when I opened the door. They were going to be gone for two weeks and
thought I would take their pregnant cat for them. I gave them my vet's # and
suggested they get her boarded.
These folks are Haitian, and I don't know if it's a cultural problem we are
having or what. :))
So Dennis fixed the mail box last night. We will send a copy of the sales
slip and a letter to the lawyer lady who knocked it off.
