View Full Version : help! k1 or k3? marriage in US or UK?

Hi! Any help would be much appreciated. I live in Utah, my fiancee
is from Scotland. She is currently here on a Visa Waiver, about 30
days in. What is the best way to go about taking care of things? We
wanted to get married in Scotland, but I was just told that it could
mean that we are apart for 6 mos. + while waiting for the k3. Can I
even file in London?

You would have to be a UK resident to file a
DCF. I am getting married in Edinburgh and coming home and filing.
We've looked into every avenue with this. Unfortunately, you do have to
wait that long, but that is the legal way. We are looking at the
positives of the situation. The time gives him the ability to sell his
house, car etc... and square things away. I am also visiting him for
several weeks in the summer while the paperwork is going through.
Believe me, nobody wants to wait that long to be with their loved one,
but you have an incredible support group here. :)
