This subject conserns my home ,but it probably falls under consumer law.
Maybe someone can help me tie it togather. I live in Texas.Approx: 7-15-03 my region experienced a horrible hurricane. I filed a claim with my insurance adjusters a couple of days later. The adjusters did not come by to assess the damages to my home. Be advised , this natural disaster gained national attention . The path of the hurricane came through the town I lived in.I understood that the damages was extensive and there were not enough adjusters to keep up with demand. My home sustained roof damages, structural damages,personal property damages and damages from wind driven rain.A couple of weeks past.no adjuster. My agent decided to call the
adjuster personally.The individual that was reached claimed he came to my property when i was not home.This person claimed there was only minor roof damage and nothing else. To sum the matter down ,this person never visited my property . otherwise he would have seen that the winds had blown two buildings over ,one on my boat. and ripped a roof from another. The windows from my home were broken out and water was running out of my home .Also,
the structural was unseen unless it was pointed out from a certain location.
A couple of months went by .Finally a adjuster was reached by phone,
actually he was the third adjuster assigned to my case. By this time the insurance had sent a small amount of money .But they had not yet been advised of the true amount of damages .This adjuster instructed me to send the estimates to the co. via fax. He recived the fax and made the comment that he never would have realized the damages to be so extensive. They would have if they had came by to see the property personally.He informed me that he would call me back. I never heard from him again. I was fed up with the whole situation .I called the corparate co. and was instructed to call a # which was the latter persons supervisor.The supervisor told me their business was final. I filed a consumer complaint with Texas Dep. of Insurance.
This department serves nothing but a waste of Texans tax dollars.The intake officer made it clear to me that they only intake info .He also informed me that they do not enforce anything that would make this company cover their responsibility. I contacted several law firms,but no one was willing to take the risk of fighting the case.I ran out of options and I am running out of time.The majority of the damages was covered from my pocket . There are
maney damages that remain unrepaired.No one will help What can I do,and why do we pay for this treatment.

Make sure the adjuster did not go to the wrong home. Fax your estimate to the insurance company again, thru you and your agent both. Also, send it to them certified mail so you can prove it. Expect a reply and set timelines in your letter for response. Try the state dept of inusrance and the state attorney genl office for help. You may have to sue your insurance company but first get a copy of your policy and ensure that you comply with all terms in the policy prior to suing. Sometimes the state atty genl. can get involved and get a settltment since this may be happening to many with the same insurer. If there is a greter than 50% chance of winning, you should be able to find an attorney to take your case. But some insurance contracts will require arbitration-mediation, precluding court action.

Elklaw the adjuster told my agents that he was at my house and went onto my roof.He also stated to them that he had other adjustments to make and was not coming back. He could not be reached anymore .I was standing in front of the agent when she was talking to him. This insurance company did recieve various pictures and estimates. It made no differance in their response .The fact of the matter is, it was a whole year and some months before I could get a actual adjustment. The adjuster claimed that there was no hurrican damages.I have actual pictures of roof torn off building,full aged pecan trees ripped out of the ground by their roots.Television ant. driven through another roof.Windows broken out . Furniture, computer ,and carpet ruined by water coming through broken windows . When this idiot made the adjustment a year later, he saw many of these damages with his own eyes.
his report was sent back to me as no storm damage present. Therefore , NO PAYMENT DUE.Be advised this dishonest behavior is coming from one of the largest insurance comp. in the US.Futhermore, this was also done while under mediation of the texas dep. of insurance. I offered TDI to come see for themselves.They informed me that they only intake info, and they are not there to determine whose telling the truth.They are determined to do nothing.The attorney generals office will be my next step,if you believe they will get involved.Also the lawyers that was contacted locally, and in the larger cities claimed it was not enough money in it to be made.Believe me that was their actual point for not taking the case. I would have been better off not having insurance at all. FEMA would have come through.If you have any other suggestions please feel free to contact me.
