Karen 06-21-2004, 05:19 PM Overtime is paid to non-exempt employees for hours worked in excess of 40 in any given workweek. A workweek is a fixed and regularly recurring period of 168 hours or seven consecutive 24-hour periods. It may begin on any day and at any hour of the day, and different employees or workgroups may have different workweeks. You are not permitted to average your hours over two or more weeks. Karen Sue 06-24-2004, 06:13 PM  On overtime, do we calculate the ot per day or per week in Calif? The Fair Labor Standards Act (FLSA), also known as the federal Wage and Hour Law, requires enterprises engaged in interstate or foreign commerce and state and local governments to pay overtime of 1 1/2 times an employee's regular rate of pay for hours worked in excess of 40 hours in a workweek. FLSA does not require that overtime be paid for hours worked in excess of eight hours per day or on weekends or holidays. However, states are permitted to provide workers greater overtime protections than those offered by FLSA. |
