That is a tough one to answer. In a case like this, blame would be apportioned between the driver, the guardrail if it was defective, and if injuries were there maybe the airbag. The airbag did not deploy, but ws there damage. From what you are saying, the injuries are minimal, which should be covered by insurance. That the airbags failed to deploy is not good and you can pursue the auto company and they may settle because it is a nuisance suit, unless you prove there is some kind of design flaw that they should have warned about as to conditions under which the airbags may not deploy. From a pure accident perspective, there is no damages, but there could possibly be a product liability/defectice failure to warn type of case since you reasonably expected the airbg to deploy to help save you from injury and it did not deploy. I strongly suggest that you consult an attorney, a reputable one. The specialty would be torts and accidents.
