Hello. I was wondering if visitation is ordered at the same time as child support? Also if you pay child support are you for sure going to get visitation? Sorry this is all new to me and I just wanted to get a head up on all of it! Thank you

child Support and visitation are 2 different issues. but you can file at same time. Child support will not get involved with visitation. so you either have to work it out or get an attorney.

Custody and support are related, but differering matters for a court. At the time custody is ordered, the court will usually give the non-custodial parent visitation, sometimes liberal, sometimes restrictive based on the situation. Support is the amount of money that the non-custodial parent pays to the custodial parent to assist in the costs of raising a child. Sometimes custody and support are inter-related because a parent with visitation may be exempt from paying child support during a time they have the child a month, like the summer months.

If this goes before a court ,the attorney should get these issues taken care of at that time.Depending on the parties situation is what determines the facts of visitation.The facts are ,the payee should be entitled to visitation of some kind depending on creditability.{behavior,background,good or bad for the child}The court looks at these things.

Even if you get visitation you may not get the visitation. We have a court order for visitation but everytime we try to pick the child up she doesn't answer the door. This is a civil matter, so we can't do anything unless we want to pay an attorney $250 to file contempt charges-each time. She missed 3 court dates which cost us $600, but she had no consequences. Don't get me wrong-she still cashes the child support checks, we just can't see the child. We have a visitation order with joint custody, but it doesnt matter. If you don't have money to fight-you lose. Attorneys won't work for free.

If you have the contempt orders and visitation order, call the police to come out when you go to exercise visitation and you are not allowed to see the child. The police can then point out there is an order and they are in contempt and if they do not comply can be taken into custody. They might be later released on their own recognizance, but until you show a desire to follow through, you are likely going to have this probelm.

My husband and I have joint custody of his daughter. We pay child support to his ex-wife. We have visitation of his daughter half of the month and his ex-wife has the other half of the month. Not only do we pay child support but we incur a lot of expenses having her half of the month. His ex-wife is changing careers and asked us to keep his daugher 3/4 of the month due to her new job. Can we get child support modified based on the child living with us more than her mom? Again, we have joint custoday, but I guess she has primary custody, since we are paying her child support....
