I just married my fiancée and we are about to file I-485. Do I have to
file Application for Employment Authorization I-765 if she is not going
to work in the nearest future? How long could the entire process take?
What are the steps? We are going to submit our papers in Arlington,
Virginia. Could you share your experience with that office? And do we
have to file Application for Employment Authorization I-765 if she is
not going to work in the nearest future?

This site http://travel.state.gov/visa;fiancee.html states that
“The alien fiancé(e) must apply for work authorization with the BCIS.”

If she is not going to work, it is not necessary to file the I-765 - if
she can wait until the whole process is complete (which differs from
state to state) her Green Card will give her the right to work in the US
while it is valid. (The work permit is really for people who have to
work immediately.)

Virginia recently changed their rules regarding driver's licenses. It might
be that she'll need an EAD to get a driver's license if she wants one even
if she doesn't intend to work. You can find my experience of the DC office

I believe that the DC office is going to be relocating from Arlington soon
but it's still near Ballston metro for now.

Danny,



A SSN is not required for filing income tax returns. A person who is
not eligible for a SS# can apply to the IRS for an Individual Taxpayer
Identification Number (ITIN) to use for filing tax returns.



What's a "POE 551 stamp"?

The I-551 stamp is given at the POE to those lucky persons who are
emmigrating to the US with an US Consulate approved spousal visa.

Since Bob's (the OP) wife apparently was a K1, Danny's comment about
getting an I-551 at the POE is not relevant to the situation under
discussion, so I wonder why he brought it up.

you might want to find out (through a lawyer or website) for processing
times in that area. if it takes less than 2 years, then you might want
to wait before you apply.



lets say the processing time is 1 year, then you should apply 10 months
before your 2 year anniversary so your interview is scheduled after
your 2 year anniversary. this way you get an un-conditional green card
and then you dont have to go through the hassle of removal or
conditions etc.
