I am currently with my girlfriend here in Canada. She is here on visitor's
permit. We have decided that we do want to get married in the US. Here are
my questions:

1-I need to be able to work as she is going to school and I am the one
providing financial support, so how would it be possible for me to work
there immediately after marriage??

2-If not immediately what do I need to do in order to gain employment there
and what timeframes would we be looking at before I start working after out
marriage??

3-Which is the best route, k1 or I-130? I was thinking of going there as a
visitor and doing the I-130 but then thought about whether or not I could
get employment while my application was being processed.

The K1 from my understanding is really only a safetyguard to go and get
married in the USA. I have heard it is easier to go as a visitor and get
married but make sure you don';t let border patrol know of your intentions
of getting married.

Any help would be much appreciated.

She is the US Citizen on a visitor's permit attending school in Canada
on a visitor's permit? Or she is the USC visiting you in Canada for the

No. At best it would 90 days maximum before you are granted the
Employment Authorization Document (EAD) which will allow you to work.
You file for this via form I-765 when you file for adjustment of status
after marriage. You will also need a social security number.

stay with the intent to migrate unless you have been approved for a
Fiancee Visa.



The K1 from my understanding is really only a safetyguard to go and get
married in the USA. I have heard it is easier to go as a visitor and get
married but make sure you don';t let border patrol know of your intentions
of getting married.



Someone has told you to do something illegal ... commit fraud at the
POE. Pre-conceived intent is fraudulent and if discovered by the USCIS
will cause not only your adjustment of status to be refused but might
cause you to be banned from the US and deported.



Far easier since you have the clear intent to marry your student
girlfriend, to do things the legal way and apply for a K-1 visa. She
can apply for you via form I-129F at the service center governing her
living jurisidiction. After approval you will be interviewed at the US
Consulate in either Montreal or Vancouver for the K-1 after you have
sent back your check stating you have all the documentation required for
the interview. She will need to complete an affidavit of support for
you for the K-1 (form I-134). Since she obviously does not have the
ability to be your financial sponsor, she will need to obtain a co-
sponsor for you. This co-sponsor will also be needed for the I-864
affidavit of support required for your filing of adjustment of status
after your marriage.

If your girlfriend lives in the Northeast, going the route of the K1 may be
the fastest route.
Getting married in the US then filing I-130 and AOS will certainly cause
problems. It
is illegal to enter the US with the INTENT to marry a US citizen if not on a
K1 Visa.

Employment authorization is another problem. The wait for this can take 90
days easily, and
for a K1 it will expire when the K1 does (90 days). You will then need to
apply again when filing your AOS.
You may want to have your girlfriend check at the port of entry you plan on
using to
see if they do the work authorization stamps. I understand this is now rare.

There is one other option. This may be the best especially if your
girlfriend does not live
in the Northeast. Get Married in Canada, and have your girlfriend file a
I-130, when she receives
notification that it has been received, file an I-129f for a K3 visa. This
is processed in
Missouri for the entire country, even though they are now running slower
than the used to it will still be quicker
than a K1 anywhere but the NE. You can still try to get a Work Authorization
stamp at port of entry.

She is here strictly as a visitor. She is NOT a student. She lives in UTAH
as well.
Once I have my K1, I know we can get married and then I can stay there, in
the US, while my AOS is being processed to become a permanent resident which
will allow me to work.
1-Am I allowed to work there with a K1??
2-If not, What is the general wait time to process the AOS after marriage?

K3s do NOT get EAD authorization at the POE, they have to file for it
through NBC. Failing to get that within the 90 days they can then file
for it through their local service center on the 91st day after their
first NOA.

You can work with a K1, provided you get work authorization, as I mentioned
earlier.

It appears I may be mistaken about getting work authorization at port of
entry for a K3. I'll know for sure in 13 days, as my wife will be arriving
in the US on the 14th from Jamaica. (K3)

Unfortunately, your girlfriends residence in UT means you have to go through
Nebraska for the K1, it will take at least 6 months for everything to go
through. K3 would be faster probably by 2 months, this would also allow you
to travel back and forth to Canada to work while waiting for work
authorization as no advance parol is needed for a K3, though for a K1 it is
required.

Trust me Eric, we have thread solely devoted to K3ers waiting for their
EADs and sadly it DOES NOT happen at the POE. I wish it did, but it
doesn't, we have to go through NBC, :(

Even if they were issued, the POE my wife will be using doesn't issue the
stamp etc. Miami. I just found that out a few minutes ago.

I wasn't concerned about it for finacial reasons, though since I tend to
have long work days, I expect my wife to become bored quickly.
I guess the next thing I need to look at will be the procedures for her to
get a drivers licenses.

When you say "work authorization" what are you referring to?
How do I get work authorization on a K1??

We really want to get married there as she needs to have a bishop wed her as
she is LDS aka mormon.
I am just looking for the easiest and least hassle to get wed her and get
working.

driver's license.

At some ports of entry you can get a stamp on your I-94 authorizing work. If
the POE issues one it will be good for the 90 days of your K1. Otherwise you
will have to file a 1-765, again if this is before the marraige, if you get
it in time (unlikely) it would only be good for 90 days. After with wedding
you will need to file again with your I-485. Based on your girls location in
the states, I believe that the K3 route would be the quickest method. My
opinion.

The K1 from my understanding is really only a safetyguard to go and get
married in the USA. I have heard it is easier to go as a visitor and get
married but make sure you don';t let border patrol know of your intentions
of getting married.
