View Full Version : Termination of Fathers' Rights - Texas

I hope I posted this in the right place, if not - please direct me to the correct location.

My story is quite confusing, so please follow along carefully and if you have ANY questions, please feel free to ask.

I have an 11 month old daughter that is a product of basically a one-night stand. We had sex once and then we broke up. Well, 2 days after I had sex with him, I met my now husband, who is 22 and enlisted in the United States Air Force. We instantly fell in love and got married 3 mos later. He knew the chances of my daughter being someone else's but he didn't care - he loved her and has treated her as his own ever since we started dating, she even calls him daddy - she has no idea who her father is nor does she recognize him when she sees him for those 4 hours once every other month.

The biological father pretty much denied us having sex and threatened to get custody of the baby, file CS against me, alot of BS basically. After my daughter was born, it was obvious that she was his because the father is black and both my husband and I are BLINDING white. He still denied her. I guess, out of frustration and being quite selfish, I decided to file for CS so a dna test could be administered and I could prove this guy wrong. Well, after the dna test proved that she was his, suddenly he wanted to be a dad which I thought was a great thing. He saw her for the first time when she was 4 mos old. For the first month and a half, he was a good dad. He saw her 2 times a week and sometimes more but when he saw her, it was basically his girlfriend taking care of her and playing with her. He changed his first diaper of her when she was 7 months old. Well, shortly after their first visit, he was informed that he was about to have a 3rd child from his other baby's mother. So, you don't get confused - he is 20 years old and he has now an 11 month old, 14 month old, and a son due in September. 2 girls have aborted his child. Well, after that, he quit seeing her so much but paid his $141 a month. I mentioned him signing over his rights ONCE and he got all upset so I never mentioned it again. He hasn't seen her in over 2 months.

Well, the other day he informed me that he wants to sign over his rights so my husband can adopt her because he feels it would be best for Danielle. I know this can be quite an expensive procedure and I want the cheapest but most effective way. How much does this usually cost? And how do I go about doing this? We're getting stationed to Germany or Japan after I have this baby (I am 15 weeks btw and due in December :)) so we really wanted to do this before we left.

When should I cancel his child support? How should I do this and is the Attorney General's office going to give me a problem about doing this?

Go visit base JAG legal assistance who should be able to assist you for free. They should be able to draft termination document and the adoption petition.

Thank you both for your advice but I have already went on base and they do not and will not handle adoption cases including termination.
