View Full Version : Got fired for sexual harrassment

I was working for a homebuilder in California until i got fired for sexual harrassment 2 weeks ago. I was working as a customer service rep going to homeowners homes and fixing any problem i could to make them happy. I was told that it sleeping or dating homeowners on my track was not permitted. Well, me and some guys I worked with decided to rent a home on a seperate track that belongs to the same company. Well.. after work we got to know the neighbors and would frequently throw partys at our house. I started to develop a relationship with one of the neighbors, who was married, but not happy. I had never worked on her home since I wasnt assigned to her track. Well, after a while of seeing each other her husband found out we were having a relaonship and I had to leave. I continued working for the same company but asked to be transfered to another track a little further. Me and this person continued our relationship and continue to do so. We have been together now for almost a year and she is in the process of filing for divorce. Well, the day I got fired, I was told that I had made a mistake in one of the homes and me and the other asistant had a phone conference with the owner. Being new at my position I failed to look at something wich caused the company some money, not alot. Well after the conversation, my boss called me and asked me to call the owner back in private. He asked me why I decided t get moved so far from home. I was honest and I told him the truth and I told him that I had feelings for this person. He told me that it didnt reflect nicely on the company and that he would have to talk to his wife about what they should do. The next day I got called into office and they let me go. I expected that and was not angry since this company had given me many oppurtunities to advance, but when I read the termination letter stating that I was fired for sexual harrassment I felt that wasnt right. I called the acting human resources manager and told him it was all consentual and would like them to change the reason but never recieved a phone call back. The woman I have a relationship with wrote them a letter with her phone number and sent it certified but we never got a response. What I am wonderng is what I should do and how I should go about doing this.. Thank you

First, you should file for unemployment benefits.

Second, my question to you is this: What do you wish to accomplish?

I already filled for unemployment, Im waiting for a decision. What I want, I need them to change the reason for me getting fired from sexual harrassment to something else. If I ever apply for a job someplace else and they ask me if ive been fired for that.. im going to have to put that I was. If this company denies me unemployment then im thinking about taking legal action.. what do you think?

What I would do is this...see if you can get an attorney to write a letter on your behalf. The letter should demand that your employer change the reason or you will pursue them on the basis of defamation of character to the full extent permitted to you under the law.

You probably wouldn't want to actually sue them because of the cost. However, the letter from the legal counsel may shake them up enough to make the change.
