I am in western wisconsin and I am accused of "misconduct meaning management style interpersonal relations and mistrust". I have been asked to go on a loa for two weeks. The person accusing me has been after my job for a few months and has already aligned with HR. I am getting a laywer but what are my rights? I got no warnings of any kind and now I am in defensive mode. what do I do?

Unless the reason for the counseling and mandated leave are as a result of a legally protected issue, such as illegal discrimination on the basis of age, race, religion, gender, disability, national origin, etc., their action is legal.
Instead of fighting this issue, you may need to give their action serious consideration of what actions you made that contributed to their move. If you still feel that it is completely uncalled for, you may need to consider leaving the company.

the supervisor below me gave me three gifts from novemebr to january one a cd of italian love songs, one a book of simple pleasures (spiritual verses on love and family) and a religious icon of support. I got promoted and he wanted to follow me with the promotion and it didn't happen. Once I left the deparment for my promotion he was allow to run the area until decisions were made. Since then his area has really fallen apart. He was about to get a review and it wasn't going to be what he expected and then this all hit. My boss went on a fishing tour to get to the bottom of the allegations and found other problems but they were all trust issues. My promotion was to a failiing area and I turned it around but my popularity amongst the team is really, really bad even though the department has improved greatly.
I asked my boss if this loa was performance based and he said no, not at all. I asked if I am cleared liked I think I will be of this misconduct can I return and be effective? He wasn't sure. Now I ask can I work through this?

If you believe that you are a victim of discrimination, then file a complaint with the EEOC. However, if you want my opinion based upon the information you provided here, you seem to be reaching for reasons as to why the counseling happened, rather than searching for the answer within yourself. The time off may not be a disciplinary supension but it sounds like something to a "time out" - to give you a chance to perhaps chill a little.

i am all for chilling out but there is something sustantial I did wrong and I don't know what it is. Based on my suspension letter they will investigate the allegations and they will request a meeting to discuss the findings within 2 weeks. I did something and the supervisor who gave me the gifts was also suspended that same day. I just have to wait and see what surfaces but in the meantime I am freaking.
