:confused: well, I been acuse of harrasing one of my coworkers, I'm his lead (i'm a girl) he does not do his job the way he supost to and i have to tell him so many times to do it. there is been two ocations where I yell at him, because he ignore me when I ask him to do his job ( this is been going for a year). before a was his lead (when he start working whit us(like 12 people)), I ask him if he wants to go out with all the coworkers that use to go out after work (drink or brekfast, we work 6 pm to 6 am this been like 1 year and a half), he said no, so i never insist no more. so we start working more together me as his leader, all the time alot of problems because he was not there, all the time that I told some thing to him he gat mad and defensive. I talk to my supervisor he talk to him but nothing change. Now he whent to HR and acuse me of harrasing him because he did't go out with me. every body from work know that he is kind a wird not a very good worker. and all the time got in discasion it was because he was not working.
now HR is investigairing but I'm worry, if i get fire what can I do? :( I work in CA

As you have experienced, accusations of harassment are made against women, as well as men. What you should do is cooperate with the investigation and, if you are innocent, I believe that the truth will come out.

However, if it was found that there is cause to believe that harassment exists, you should talk with your company as soon as possible, giving them assurances that it will not happen again. The goal of the company is to stop any harassment. That doesn't always mean termination for the alleged harasser.

well it looks that HR representative or the one it was in charcheg of the problem it has ser own opinion abuout the situesion from the start of the investigation. She toll me alot a thing (lies) that people said, that I know that is not true even she toll me that I said things that I never said, and the report that she give to that main person how sing me termination it was all mix she make it look that I was not respecting the comands of my supervisor and still yelling to this guy which not of this was true, she never call persons that all toll her that they can coloberate my history. so my question is can I sue the company because it looks that she change the statments of the witneses and as she said I had a clear record but still they termined me do I have a caise? :confused:

Personally I would hire a lawyer for unjust termination. Or I would seek legal council immediately. A sexual Harassment termination will remain on your employment record, and can verry possibly affect your future employment.

You can hire an attorney but it will cost you a lot of money. Instead, you should go to your former employer and ask that they would change the reason for the termination to resignation. Thought this will prevent you from getting unemployment, it will help you when prospective employers call your former employers asking about your employment record.

Also, make sure you learn from this experience. Never mix personal relationships with work.

welll in HR they toll me they will not realese the reason of my termination because is inligel It is this true? becuse in the case of sexual harassing they did not find anyting so they drop that but they fire because "Rules of conduct" and it was my firts ofence just to one person , but I never toll him anyting, I just toll him to go to work, and I was in the position to tell him because i was his lead. But it look HR mix up all the steiments and I know this because they mix mine.

Then, your only recourse is to seek legal counsel. However, as said earlier, this could be an expensive proposition and there is a possibility that you will not be successful
