My wife is due in a few weeks and I would like to be at the hospital when she has the baby and some time with them when they get home. My job says they only give 2 days paid maternity leave but I have heard of others at work getting up to a month paid leave to have a baby. No one can give me the same answer twice on what Texas State law says about paid maternity leave. I just want some time with my family and not have to worry about money when I do so.

Fathers can take an FMLA leave if their employer has at least 50 employees in a 75 mide radius and the employee has worked at least 1250 hours in the last year and if they have at least one year of service. FMLA permits a leave for fathers on the basis that the mother of the child is "ill" and needs his care. This leave is on an unpaid basis. However, their employer may permit the employee to use any sick and vacation pay that is available.

Texas does not have a paid maternity leave program.
