I live in Philadelphia,PA and have a 11 yr old daughter.My mother has had full legal custody of her since she was 8 months old.Her father currently pays support because my mother is getting cash benefits for her.I am a single mom of 4 children,2 of my children are disabled and I am receiving benefits for them.I am not working at this time.Why am I being ordered to pay support when her father is paying and welfare knows my situation? Is there anything I can do? If i do not appear in court,my mother and my daughters father do not appear either,who will they issue a bench warrant for? My last court date was in November of 2004,in which they had summoned my mother who did not appear.I did and now I am to go back.My mother is claiming that she has not received her summons for court and if she had,she will not attend. In November of 2004,I explained my situation and showed all my paperwork proving that I cannot afford to pay.I have not been summoned before this and I do not understand why it is happening now.Also,since I am receiving disability benefits for my 2 sons,can they touch that money for what I owe in arrears?

Because you are a parent, you have a moral and legal obligation to provide financial support for your children. If you are unable to provide support, you may want to consult with an attorney to deal with the court.

Also, check with disability advocates in your area. I don't know if creditors can take the income of a person who is disabled or not. It used to be they couln't but I don't know about child support.
