View Full Version : Working w/ out a break, and not getting paid for it

> I'm not sure who I need to talk to about my issue. I worked for Texaco
Express Lube in Jacksonville Florida (North Florida Lubes). During my time there I was never
given an actual lunch break. My hours of work was from 8am, to 6 pm. 6pm
is when we close the shop to the public. Sometimes we would not be able to
close until 6:30 because we still had cars showing up right at 6. But we
still had to clean up the shop and measure the oil tanks, and restock oil
filters. Doing so I would leave at eather 6:30 or later. Now my boss would
arleady have me clocked out at 6, eventhough it was 6:30 or later, just so
they could keep their cost down. Now to me this does not seem fair. They
take my lunches away from me. I'm stuck down stairs in a pit for hours in
almost 140 degree temp. I have almost passed out down there. Missed my
days off because they would not tell us the shcedule was poasted. Got sick
from over exposure to heat, miss one day(making this my day off) and they
would threaten me,with eather writting me up or termination. Keep in mind
up untill then I had no day off. And was not aware that I had that day off
until half way through the day, 2pm. Mark told me "I am failing my family,
because I missed work, and I am not doing my job as a parent". And if this
happens again then some one will have to put a foot up my *** or I will be
fired, and then my family will starve, all because I missed work," do to the
fact that I faild to work that day, even though my supervisor Vinney told me
that I needed to rest. Also the conditions were not safe. Half the time
the people up stairs were not paying attention to the echo safty calls. And
driving or starting the cars with my arms, or hands still in the engins.
Every were else I worked when dealing with used oil and other chemicals,
gave us gloves to protect us from exposure. I would be covered in oil,
transmition fluid, and gass all day long, having to eat as I worked, without
really being able to wash my hands or face. The grates or catwalk was not
secured properly, often moving out from under me. This happened to me as
well as my boss Vinney. He still has a not the size of an egg on his lower
legg. I fell through almost to the floor. Again not sure whom I need to
speak with. I'm not the only one they did this to about the lunch breaks.
Texaco Express lube (North Florida Lubes) also owned a carwash and the
employee's were mainly under age. They to were not always given lunch
breaks. I feel that this is not right of a business. If en employee works
with out a lunch don't take the time from them. They should be paid for
their work.

Mandatory meal periods are governed by state law. Florida does not mandate a mandatory meal period (unless you are a minor). So, your employer does not have to give you time off for lunch.

On the other hand, working off of the clock is illegal. The US Department of Labor Wage and Hour Division will aggressively pursue any employer who is forcing their employees to do so. You should report potential violations to the Wage and Hour Division in your state (the number of which may be found in your local telephone directory under the Department of Labor within the US government section).

Also, safety is another potential issue by your employer. You may call your local OSHA office (again within the US government section). They will investigate potential violations of the safety regulations.
