I live in california in a gated community. For four years i have lived here without incident or fines. On one occasion i cought the pool attendant staring at my balacony on the second floor. I video taped this for twenty minutes while he stood there . He got mad when i started to video tape his behaiver.
To the point: Some tenant he pissed off started posting pictures of the pool attendant around the complex with "Poop" slogans on thease pictures. I recieved fines(after thease pictures showed up) dating back july 4 2004 for drinking beer where visable to comon area and fines for thease pictures. I did not post thease pictures. When I talked to the manager I told her it wasnt me. She stated to me that there was no proof of who was putting thease pictures out but the mainmance guy blamed me.(She said the attendant said a flash come from my house) She stated to me that she was going to discard the fines. Two weeks later my landlord recieves more fines for thease pictures. I went to the managers office again and she said the homeowners made her resend the fines. Than my landlord sends me an eviction notice. So I called my landlord and he told me that due to thease fines we were getting evicted. The manager also told me that anyone can report me for a violation and i have to pay no matter what. Only homeowners can go to meetings and dispute fines. As a renter I have no rights. My landlord lives in another state, he doesnt have time to come down here and fight for thease fines. After pointing out that the pictures were taken in broad day light how did I get accused the complaint said the attendant saw a flash, they than changed there story . " Now someone saw me post pictures" I did no wrong Can anyone help?

You should be able to prove the pictures weren't taken from your apartment. Try taking the same photo from your balcony and compare it to the posted picture - that should tell you if the picture was taken from the left or right of your place.

IF you believe the fines to be illegal, let your landlord know and there may be some kind of standards based on the rules of the community that can be challenged in court if this is a case of accusatioin and no proof. Also, there may be some kind of review process within the community board that should be exhausted prior to going to court. However, since you are just leasing, the owner would likely need to pursue this further, or you pursue it on his behalf if he empowers you to with formal authorization to act.
