left work to have a drink at local bar. I found 5 of my employees also having a drink. One of them was really intoxicated and asked me to take her home. I said no and called another employee of mine and asked her to take her home because it wouldn't be appropiate for me to drive her home specially in her condition. She agreed. And I also explained to the employee that was driving her home, the reasons why I couldn' take that employee home. Several days went by and I found myself closing shop with the employee that was intoxicated the night in metion. She asked me to go for a drink with her an a group of employees. I said yes, why not? after having 3 beers I told my employee that I had to leave to meet my girlfriend else were. I need to take you home, she did not have a ride this time nor I had the option of asking some else. I took her home,she got out of my vehicle and that's the end of the story. I am being investigated of sexual harrasment! I will probably loose my job. It's really a she said he said deal. The prospect of loosing my job is upsetting, however what is more upsetting is the personal attack to your integrity not only professionaly but personaly. What can I do to defend myself? They say employers fire people just because its easier for them to deal with stuff like this, is it true? what do the statistics say?

It is truly maddening that people are using the law inappropriately. In order to defend yourself, you will want to have evidence that it was she who initiated the ride, etc. It would be helpful if you could provide evidence that she had been drinking heavily and that she had asked you for a ride. Further, when she asked you, you initially denied to give her the ride. It was only after she asked you again, that you were forced to give her the ride. It would also be helpful if someone could say that she was making overtures to you.

An investigation was performed as the protocol of my company dictates. She claims that I had innapropiate contact before she go out of my vehicle. The facts are totally different. I met my superiors outside the office and made a written statement. He said " these are some serious allegations against u and I don't think I will be able to save your Job. Wait a minute! So I am guilty of this??? Anybody can make a claim about anything they want, proving it it's a totally different story! I will interview some other people and see if I can stablish a pattern of innappropiate behavior. depending on the findings chances are you will be terminated, my superior added. he found nothing and in a nutt shell, I still kept my job, however I am being transfered to diffrent location or city for obivious reasons.I kept my job and their is some what of a feeling of vindication, however I still have a sour taste in my mouth. Defamation cases are so hard to win, someone has to actually testify that they saw her making advances to me or that she had a hidden agenda. I don't have that "someone" so in all honesty I got slapped in the face and I can' really fight back? I will probably end up resigning my position, relationships I feel were distroyed with my superiors and that they are always going to wonder what realy happened in that vehicle..........

I completely agree with you. While I am a strong supporter of the rights of victims in cases of discrimination in workplace, I am also appalled by the abuse of the system. Fraudulent claims degrade the credbility of all victims of discrimination and causes harm to persons falsely acused of discrimination. I wish you the best of luck in your job search.
Have you tried to turn the boat back on this gal? For filing a false claim? I've seen it done in the service...it's really the only way to curtail false claims. Just a thought.
