I work for a construction company in Deer Park Texas. I go to different plants. I was placed at a new plant Dec 28 2004. The site consist of five women in the office areas and the rest men about twenty five. Since I have been on this job. I have be subject to crude remarks about women that just gave birth and fowl language. The computer the gave me has a pop up picture of this women in a bathing suit and it says party poker across the top. I have talked to the office manager about it and he has seen the pop up. I also told my boss and they have not responded or toke any action. About a week after I started working their this one guy started coming up behind me and shaking my chair or if I was standing in front of the file cabnets he would go out of his way to push up against me or elbow me in my back and say I'm not touching you and walk off. Well Thrusday I was sitting at my desk and he came up behind me and grabbed me under both my arms. I jumped and spun around and he just laughed and walked away. Later that day he walked up behind me and said hay and I turned around and he grabed me by my throat with both hands and said I ot to shock the crap out of you. I asked him if he was goofy or what and he walked away. Later I was standing at the file cabnets and he walked by and pretended to run into me and said I'm gonna bring my belt tomorrow and make you mind I got one big enough too. I talked to a friend and she told me to report him to the project manager but he has seen him run into me or elbow me in the back as he was walking by and never said a word to him. So the project manager is aware of some of the stuff he is doing to me and letting him get away with this. I need my job what should I do. I feel like they will lay me off if I say anything.

What you are describing is a typical example of sexual harassment. If you report their behaviors to the EEOC, you will be protected against retaliation. You can read more about harassment and discrimination at: www.eeoc.gov (http://www.eeoc.gov).

I reported it to the EEOC and they told me the company had taken action and their was nothing they could do and dismissed my claim. What do I do now the man continues to work in the same office as I do and I was told I would work with him in a professional manner. I was advised by my employer that I was not to allow this to effect my performance.

You say that the EEOC said that your employer took action on this. Does that mean that they investigated it and took action to stop the harassment? (It doesn't say that in your first posting.)

If so and the discrimination/harassment stops, you do not have any recourse other than filing a lawsuit. Since you do not have a for cause determination from the EEOC, it will be an upheld battle.

I went to my employer after I posted the message and you replied. My employer called him in the office and talked to him and then they called me in and told me they had spoke with him and we were to work together in a professional manner. They also told me that I was the type of person that couldn't say (NO DON"T STOP) say they would do it for me and not to let it effect my performance. They would see how it went and we would go from their. The guys make jokes about it and make remarks. I wrote a letter to the EEOC and they told me since they did talk to him they toke action and their was nothing they could do for me.

If this harassing, etc., continues after the EEOC has made its determination, you can file again. It is now a second cause of a complaint.
