I work for a company that is not located in the state I live in (va), I am list as a salaried non-exempt.The way they pay my overtime is taking the salary per week divided by the hours worked that week (ex 50 hrs) and times that rate by .5 and pay the 16 hours at that rate.is this correct.Also as a service tech can i be salary?


ex 800 + 50 = 16.00 an hour
16.00 X .5 = 8.00 an hour
8.00 X 10 hrs = 80.00
800.00 + 80.00 = 880.00 for the week

I believe so, assuming that they pay you for 40 hours a week, except for full day absences. Let me do the math and get back to you.

No, do you know someone by the same name there? I work on my own. Your company is paying you through a concept called the belo plan...which is permitted if you are not docked for time less worked less than 40 hours and if your responsibilities require a need for a flexible and varying schedule. (Drawing from vacation for time off is permitted.)

800 divided by 50 = $16 per hour
$16 X .5 = $8 an hour for ot X 10 hrs ot = $80 for ot

ex 1 $800 divided by 50 = $16 per hour

ex 2 $800 divided by 60 = 13.33 per hour
$13.33 X .5 = 6.67 an hour for ot X 20 hrs ot = 133.20 for ot
$800 + 133.20 ot = 933.20 for this week


Is this correct can they change my rate of pay for overtime on a weekly basis according to the hours I work.

Yes, overtime rates are calculated on a weekly basis. So, your employer is calculating wages correctly.

Thanks again so it is correct that my overtime rate drops the more hours I work? How can that be fair when you make less money per hour the more you work? Is this still the belo plan?

The offset is that you are supposed to receive the minimum amount of 40 hours, even if you work less than 8 hours, on average, per day.

Yes, it doesn't seem fair. However, that is how it is done. If you want, you can verify it with the US Department of Labor, Wage and Hour Division. You can find them in your local telephone directory under the US government listings. They will be glad to assist you.
