My younger brother just got in to som trouble @ school. another boy said that he saw my brother break on of the teachers windows,the boy signed a affadavit statting he saw my brother do it. I wanted to know my brothers rights are as a minor. i am in texas

Typically, if a student is detained in the juvenile justice system, a parent or guardian has to be notified, then a hearing is held. In some cases, the state will seek to try the kid as an adult. This does not sound like a case like that unless your brother is 16 years or older. However, this sounds like vandalism.--If you come from a low income family, the state should pay for your brother to have legal representation by an attorney.--At this point, you may want to find out if your brother has alibi witnesses that he did not break this window and have them do affidavits that he did not because he was with them or they saw him, etc.... Also, the affidavit may be enough to hold your brother over for detention and charge him, but may not be adequate to find him guilty of anything. ---Your brother needs local counsel if counsel has not been appointed for him yet.
