View Full Version : Want full time but no benefits Ohio

Hi, Okay. I am currently working part time as an office manager. My boss has told me that come May they would like to make me full-time, the only problem is that they cannot afford to do this if I need/want the benefits. I was recently married and I am taking on my husbands benefits, so I am not in need of the company's that I work for. The higher up is saying that legally at full-time they have to offer me benefits. Also- is the amount of hours that distinguish FT or PT in Ohio Law?
Is there any way around this? What can I do or where can I research?

It's not wage and hour law and there is no law, either federal nor in Ohio, that defines what FT or PT are.

What it may be, though, is that the plan or plans are subject to ERISA, and there are very strict rules in ERISA regarding such plans at least being offered to all employees who are eligible for the plan according to the plan rules. Examples of such plans would be pension or retirement (like 401K) plans and pre-tax group medical insurance.

But, by the same token, just because you would become eligible does not mean you're going to enroll. For example, if you would be eligible under the group medical insurance plan, it is offered to you, and you waive/decline the coverage, it's not going to cost the employer anything. Maybe he's afraid you may change your mind?
