I was terminated from my job from a small company in georgia. My company used to pay for my health insurance, since as a small firm they did not have a group plan. After termination, they paid me only a part of the insurance for that month (less than prorated to the day of termination). When I asked them about it, they told me that they are not liable to pay benefits for employees after termination. But I guess this will not apply as the benefits I am claiming are for the period I worked there. Please let me know, if this is legally tenable.

Employees participating in a group health plan sponsored by their employer of 20 or more employees must be given the option of continuing their health insurance, albeit at the cost of both the employer's portion and the employee's portion of the monthly premium (plus a small additional fee to cover administrative costs). This provision comes as a result of COBRA, a federal statute.

It doesn't sound like your situation qualifies in that you are not in a group plan and it sounds like your employer is too small to be covered.

As far as the current month's premium is concerned, your employer does not need to provide that money to you, unless there is an employment agreement, such a CBA, in place that requires the payment of that money.
