 I have gone to school for truckdriving, cdl and past all tests. I applied to a company which instisted on me climbing an A frame ladder by using the second step. I have a fear of A frame ladders. This test is to show that I can climb into the back of a smietrailer, I can use a step if I have to. I was denied this job due to the ladder. My school recomended this company knowing what my handicap was. Is this fare.
Thank you

Federal law protects persons with a disability from discrimination. It also requires that employers provide "reasonable accomodation" to enable persons with a disability to work.
Disability not only includes physical disabilities but also mental disabilities. If your inability to climb a latter can be verified as a mental disability by a licensed psychologist, you may have a disability. A reasonable accomodation may include things such as providing an alternative means to get to the top of the truck, etc.
On the other hand, if the need to climb an A-frame latter is mandated for safety reasons, it is extremely expensive to modify the truck or the requirement or due to road regulations and a reasonable accomodation is not available, your potential employer may not need to hire you.
My suggestion to you is this...you may wish to talk with your local US EEOC office. They can provide you additional information on your specific situation. Let me know if you have any additional questions.
