For the past several months my wife has been harrased and threated job loss from her office manager. It all started after we had our first child. Shortly after birth minor complications to my wifes health adn onset of depression had virtually made it impossible for here to start work on her scheduled return date. She had finally returned after constent harasment from her manager. She had threatened my wife that she would be replaced if she had not returned, regardless of her medical complications. Once whe started, she was accused of saying negative thing about her manager during the time she was on medical leave. Though I know this was not true, I understand that there is nothing that could be done. But her hours were severly cut from what she had been working before the birth of our child. Again today, she was threadend she would be terminated if she had another schedule doctors appointment when she was scheduled to work. Now with all of this happening, her office manager had verbally abused my wife and threatened she would be fired in front of the office staff. Is there anything within the New Mexico labor laws that can be done about this situation and harrasment that is continuing to happen?

Was her absence covered by FMLA? How long was she out?

My wife was not covered by the FMLA because her employer employs less that 50 individuals. She was out of work for 3 months.
