California. If an employee works 7 hrs for private work and 8 hrs for public work each day (15 hrs total), from M-F and his private rate is $10/hr and basic rate for public is $20, how do we determine the overtime & dt hrs and the ot rate and dt rate? Does the fringe benefits play a part of the public basic rate? What do we consider as fringe benefits?

Please advise.

By public work, I am assuming you mean on a project governed by the Service Contract Act or Davis Bacon Act, right?

Correct. Is there a different between the Service Contract Act and Davis Bacon Act?

Yes. SCA covers service projects. Davis Bacon is related to construction projects.

If an employee is working for the same employer in two different jobs, the basis of pay is calculated as the weighted average hourly rate earned during the week. (I am assuming that the employer is a private employer, not a government entity.)
