View Full Version : Unemployment fraud for up to 10k in Ca. - need help California

My brother in law was fired in December and began collecting unemployment insurance. During the following months, he periodically worked for his former employer (the place that fired him) and was getting paid in cash, but never claimed it to unemployment and continued recieving benefits for about 6 months. He got at least 10k from unemployment insurance.
Now, unemployment is about to find out that he was working for cash-as a result of a benefit audit.

What will happen to him?
Can he avoid prosecution & jail?
and if so, how can he avoid it?

I don't agree with what he did, but he has a disabled wife that completely relies on him (she was brain damaged in an accident) and needs him to be around.

Sorry, but the LLT crystal ball is out for recalibration. We have no way of knowing what will happen.

He needs to talk to a lawyer who can get details unavailable to us here. There are some things that a message board just can't help with and this may be one of them. If it had just been a couple hundred dollars I could see it going for simple restitution but 10 grand is another story.

My sympathies to his family. That must be very hard.

That crystal ball just interrupted me with ball waiting.

The system in my state just counts it as an overpayment, and deducts it from the next few unemployment checks.
