When I got pregnant I immediatly applied for and was approved for FMLA. I used FMLA days throughout my pregnancy for sickness due to pregnancy and for drs. appts etc. At the time of my approval for FMLA, I was not notified that when taking my Short term disability for maternity leave after I have the baby I would also be using 6 weeks of my FMLA time. I had the baby a few weeks ago and my employer recently contacted me to notify me that I don't have enough FMLA time to cover the full 6 weeks that I will be off work for maternity leave. They also said that because of this I may not be guarenteed a job after my STD is up and that I may have to reapply for the job. I am in complete shock over this and very upset. I was completly unaware of this policy, I thought that FMLA and STD were completly seperate. Before I went on leave I looked up my companies policies on FMLA, STD, and Maternity leave and it didn't mention this anywhere. When approved for the FMLA for pregnancy I was never notified of this policy by mouth or in writing. What should I do and what are the laws on this? Thanks.

To find out information about your rights under the federal FMLA, go to the U.S. Dept. of Labor website, www.dol.gov. Also, check with the Florida Dept. of Labor, http://www.afscme.org/otherlnk/weblnk29.htm, to find out if there are any state laws that may apply.

For information regarding your rights as woman and being preganant, go to this website, http://www.afscme.org/otherlnk/weblnk21.htm.

Good luck.
