I am an exec admin to a CEO of a large company. He has repeatedly asked me to dinner, drinks, makes sexual references about me to other managers, asked me to "spend the night with him" on two occassions, and kissed me at the company Christmas party. If I quit, am I entitled to unemployment in New Jersey?

By the way, I have told my HR manager about every incident since the Christmas Party kiss and HR is too afraid to do anything about it (my CEO owns the largest share of the company).

If I were you, don't quit if you can stand it all. It is much more difficult to gain attention to a discriminatory/harassment issue if you are not employed by the company any longer.

Harassment such as you described is considered discrimination on the basis of sex. You can read more about such discrimination, including the procedures to file a complaint, at: www.eeoc.gov (http://www.eeoc.gov).

As far as unemployment is concerned, if you quit, you will need to prove that the situation was unbearable. You will have to be in the position of defending your reasons for quitting. This isn't as advantageous of a position as being fired/disciplined for not cooperating with the advances, etc.

If you decide to file with eeoc, there is a web site on 9to5 National Asscociation of Working Women by a member that talks about what to expect throughout the process. Another place to go to get good legal advice is Equal Rights Advocates. There web site has tips guiding you in building your case (and you will need to build your case).
