View Full Version : Plaintiff keeps postponing

I have been in an accident lawsuit for almost 3 years now. The accident itself could hardly be called an accident. The plaintiff jammed on his breaks in bumper to bumper traffic and caused me to hit him. I wasnt even showing up on the speedometer i was going so slow. Of course he got out and put on a neck brace but refused to go to the hospital. He filed the lawsuit on the last possible day he could. I ruined his life according to him. Ironic enough this,literally, 350lb man starting having back problems...what are the odds of that. Turns out he had surgery a couple of years prior from another accident that ruined his life. He decided he wanted to switch his doctors after my accident too so he could start fresh. The old doctor has him as still complaining about pain in his back but the new one believes that he was perfectly fine until our accident. The man has been unemployed for almost 2 years now and has been living on lawsuit after lawsuit. Despite the fact that he used to work for a moving company his shoulder now hurts and he needs surgery on that too. I want this finished but he has managed to have every meeting from depositions to arbitration postponed more than once. My lawyer says there's nothing he can do about it. Does anyone know what I can do in this matter? I'm pretty sure he's buying time to come up with some more imaginary injuries like the other ones.

Unfortunately, postponing cases is one of the major flaws in our legal system. Things can drag on for years.
