I am helping my husband type up a parenting plan to file with with our petition to establish paternity/custody/timesharing. My step son is 8 and up until now there has only been a child support order in place and nothing regarding vistation.
Aside from the typical time sharing arrangments and joint custody, there are two specific things we are asking the judge to grant. 1) Ex helping with the transportation 2) My husband being able to claim my step son on taxes every other year.
A little background on the transportation issue...we currentely live in a different county in Florida that his ex, the mileage between our homes is 62 miles. We moved out of the county ex lives in when my step son was about 1 and 1/2 due to there being no job opportunites for my husband out there. Up until about 3 years ago, ex and my husband shared the driving for visitation. My husband would go get SS on Fridays and ex would come pick him up on Sundays. Then one day out of the blue she decides she's not helping anymore b/c she "doesn't want to", so for the last 3 years my husband has been doing all the driving both on Fridays and Sundays. Because his ex just took him back for more child support that will likely be double of what he pays now, we can no longer afford the gas for that every other weekend. What do you think the likelyhood of a judge ordering that they both do half the driving?
With the tax credit, we have never got to claim SS, and he just turned 8. I think it's only fair that my husband get to claim him every other year as he provides more financial support for SS and he would benefit more from the credit since he's in a higher tax bracket, is this typical to be awarded?
