View Full Version : Is this just unfair or this is legal? Arizona

Ok so i got fired from my job. This is the story...

I was new to the job. had only been there for two days. i went to my break and bought a sandwitch. i left the sandwitch on the cash register with me. with 10 minutes left of my stift i went to straighten the store. when i came back my stuff was gone. i had asked a lady (who was a manager and i didnt know) where my stuff was. she said with an attitude that she through it away. I said why? She said it was because we werent suppose to have food at the registers. (being new i didnt know that) so i got upset. I would have accepted that if she 1. wouldnt have thrown my stuff away and 2. she didnt have the attitude. As i walked away i said under my breath thanks a lot u little witch. one person heard me and thought i said *****. so they took it to the manager.

The manager said that i would have kept my job if the lady would have accepted my apology but she wouldnt so they fired me. they said that it was a respect issue. i told them that i felt disrespected when i asked where my stuff was and she asked me with an attitude and that she throw my stuff away. they said they werent going to do anything about that cause i was in the wrong having my stuff there and for calling her a witch and that she was a manager and she could do that.

Is firing me for that illegal or was it just unfair?

It was not illegal. And I'm not even 100% certain it was unfair.

So in your eyes everything was fair? I dont think it was so fair that they fired me for the name calling and did nothing about her attitude towords me. I would be ok with the firing if they did something about her. they told me inside the convo that this lady has the highest turn over rate in that company.

A person that had only worked for me for 2 days and was already calling others names would be gone from here as well.

"Fair" is way too much of a subjective term to even have any relevance here, learn from this and just move on.

thanks for advice. just one more question! how long does an employer have to issue your check after being terminated?

From the AZ ICA site;

When must an employer pay someone who has been terminated?

An employer must pay someone who has been terminated within three of the employees' working days or the next payday, whichever is sooner. School districts may pay wages due the employee within ten calendar days from the date of discharge.

thank you!!! so i was terminated on sunday nite so i should be paid wednesday rite?

If you were scheduled to work Mon., Tues. and Wed. then yes

I was off mon and wed. but one other thing is we get paid for the last two weeks thursday so i should get paid then for the four days i worked right? im just checking cuz this is all new to me.
