View Full Version : Ex is trying to change the visitation schedule... North Dakota

Our court order says I have my daughters 6 weeks of the summer, two weeks each month. It says June, first two full weeks, July and August, second two full weeks.

For the last two years I have had them from June 1st to the 14th, and in July 6th or the 8th to the 20th or 22nd. I have this as irrefutable proof.

Now for both June and July this year he wants to change the dates by almost a week each month. I told him March 9th that I could not agree to a change in July because I am due to have a baby and wouldn't be able to travel after the 20th. (We meet half way between Fargo and Minneapolis for the exchange) He never responded to me in regards to that until a week ago.

We are going to end up back in court anyways because of schooling issues with the girls. I believe (and am looking for confirmation or contradiction) that because I have two years of proof of when visitations have taken place, and our communications about it, that it is likely that since he doesn't have a stated reason as to why he changed it, the courts would likely adjust it back to what it has been previously.

I also am going to ask the courts to take the order and apply dates to everything and to clairfy everything since he trys to add his own meaning to their verbiage to suit himself or screw me.

Judges tend to go with the status quo, especially when that has been according to the court order. It's likley that his request will be denied, but there's never a guarantee.

Since you're going to be in court anyway, it will be a good time to clarify the order.
