My wife and I have been seperated for almost 2 years. We have 2 children. They child in which we are debating over is a 5yr old boy. We've had both kids exactly 50% percent of the time each week all this time, but I've been taking care of the 5yr old while she was at work for the past 9 months. So, I've actualy had him more like 70% of the time. We had decided almost 2yrs ago, that he would go to school in my school district, no she is trying to change that. At this point I would like to change the custody to 70/30 me and not realy change anything. Will having him all this time have an effect on that to a judge? I'm in a position to be able to spend much more time with him, sinse I am working towards a career working more at home. Can anyone give me some clue were I stand on this? Thanks

Yes, Judges usually look at the status quo so it can help your case alot.
Are there any existing court orders?
Was your agreement for the schooling put in writing?

nothing in writing. I also have a 9yr old son from a previous marriage, to whom Chase is very close with. It has always been our intention for the two boys to go to the same school. Both of the boys have been looking forward to going to school together for a very long time.
