I have 3 children whom i want to seek full custody for, or possibly terminate the father's rights. their father has not been present in their lives in over 2 years, and has not paid child support. he was neglectful and abusive when he was in their lives. i have a 2 year old who doesnt even know him, and considers my husband his dad. i know i need to file papers, but i dont even know where their father is. anyone have any advice or know what to do in this type of situation? my husband wants to adopt my boys, but we cant do that unless their father no longer has rights to them, right? any help and advice will be greatly appreciated.

Were you married to thier father?
If not, are there any court orders that established legal paternity?
Is there a court order for CS?

no, i was never married to their father, but he did sign affidavits when they were born that stated he was their father. there is currently no court order for support,child support enforcement has been looking for him for the past 2 years, and finally found him today, in another state somewhere, and he's not working, so any support i recieve would be minimal.

You will need to notify thier father and ask that he relinquish his rights. An adoption can be very complicated, so hiring an attorney is really best.
