I have a few questions and didn't really know where to turn....
My situation is a long story but I will try to make it short. My boyfriend and I lived in an apartment for 5 months. We had constant issues with the neighbors and complained to the manager several times. He decided to give us a 30 day notice one night because we made a little noise in retaliation to the neighbors. We have moved to Idaho now and asked our security deposit be sent to us. When we received it we found that $185.00 was taken out for carpet cleaning, $132.50 for regular cleaning, and $35.00 fee for two small items left behind. Mind you the lease stated there was a $175.00 nonrefundable cleaning deposit. The letter said it was for heavy pet dander, oil and hair. Firstly we had one short haired cat there for 3 months and another short haired for 2 months, with baths and vacuuming regularly. On top of this I cleaned the place spotless before we left, even took pictures.
We have sent a letter to the manager as well as the owners explaining the situation over the few months lived there and asking for more of our money back.
My questions are....do you feel we have a case for small claims? I can provide more details if needed. With that we will need to travel back to Oregon to submit paperwork and go to court if it proceeds that way. Can our suit include the gas and time it took to do this?
