I know the regs allow ERs the right to charge an exempt EE's accrued vacation/sick bank for partial day absences, so long as the EE has enough time available or the time off period is 4 or more hours.

Someone told they knew it to be 2 hours. Has anyone ever heard of the 2 hour rule?

This is something of a grey area. The DLSE had made the statement that requiring the use of vacation time for four hours or more is legal. They have NOT made any statement, either for or against, the application of vacation time for less than four hours.
