I am working at my job for over three years! i started in high school was was consided part time and only working about 20 hours. When I started taking college courses at a community college my boss started working me 30 - 35 hours a week. Right now I am not in school and I told him I could work full time hours. Well he has been working me on avg. 35 hours a week. I am at my job over three years and I am not getting any vacation, holidays, sick days or anything. I had approched my boss about possibly getting a vacation because of being there three years and he came up with every excuse as to why I wasnt eligable for vacation. So about three weeks later he had a posting on the local career link with the same excat job postion I was doing and in it said they would get full time hours ( 35- 40 hours a week ), 2 weeks vacation and every other weekend. He wanted at least a year experience working in the deli or as a food preparer. And I found it unfair because I am working there 3 years total and about 2 years ive worked in the deli there. So I had once again approached him for the second time and had printed out the job posting and showed him asking why I am not getting the every other weekend, the 2 weeks vacation and the full time hours. He gave me every excuse in the book, says I never "offically" told him i was done college classes, said he only has me "part time" .. but still gives me 35 hours. So I asked him " So you will hire a new person, give them vacation and every other weekend and cut my hours" .. And all he said was I will give you as many hours as I feel you can handle". Than he told me he was looking for someone older than me to do the position and that he feels I can not handle doing what he is looking for. Even though I am working in that deli for 2 years! That was the end of that arugement. I just kind of gave up there, because I dont know what to do.
Now I had recently found out he is giving 2 weeks vacation to this lady whom just started working at the store 8 months ago. I feel like i deserve a vaction. I mean I am there 3 years and shes not even there 1 year. I feel I am being slaved around! This lady gets every weekend off and i pretty much work every weekend. And shes getting the 2 weeks vacation and shes not there a year! What should I do??

There is no law in Pennsylvania that requires any employee be offered paid vacation, holidays or sick days. And illegal age discrimination does not kick in until age 40.

It's too bad the boss doesn't appreciate you more, but there is no LAW that I see being violated here.

All I can suggest is to look for another job that gives you the hours you need/want and that works around your school schedule. Until then, you may just have to stick it out.
