My Husband and I were Divorced in April 1998, In My Original court Order My Husband was to pay Child Support for my 3 Children at that time aged 9 were my Son and my Daughter who were 9 months apart in Birth, and then my younger son age 3. Then for me I was ordered to pay the Medical part for the Kids.. When the Divorce was Final My Husband had a very good paying job with excellent Benefits we had a verbal agreement that he would pay the Medical for the kids because it was all paid at 100%. The Child support came as it should on a Montly Basis, but he had no part in anything else as far as clothes, sports equipment etc. and the list goes on, thats ok because they are my kids and I will do any thing for them. Now as years past, he is now on Social Security Disability (RSDI) and my children did recieve part of that Benefit also along with Child Support. 2 of my Children have been dropped because of there age now, but my younger son is Diabled he is now 14 and still gets the RSDI from my Ex- Husband, We are both remarried now I have been for 10 years now, He remarried the year after our Divorce and right away had a nother child. So his younger child is 8. Any way I cant tell you how he has never ever left me alone isn't that the purpose of Divorce get rid of the creep, but take care of your children, well in my case that has not happend.. now Last year he Divorced his New Wife and became Hooked on Pain Killers Oxy, Vicadin you name it what ever he can get his hands on he consumes it. I am sure this has been going on for as long as I can remember because he does have a back injury, so he says... Ha Ha... My older Children have found Numerous bottles of Pills around, including several bottles from Different family members, so we think he is a full blown Junkie asking who ever he can to get the Pain Killers in fact people are coming over to his house to give to him, my Children have seen this on several occasions... So he was complaining to me how broke he was all the time I felt bad so I called the county up and had my CS Stopped, I told him that if he sent me a check in spring and fall to help cover clothes etc. that would be fine, but never saw anything and besides that now he is telling me I will have to pay back all that social Security money my Children got, I told him I never asked for that at all it just starting coming every month, So my "Question is I am thinking of re-opening my Divorce Decree and having more than a few things changed. I never got any of his Pension, Retirement or any such thing from him, because I just wanted it over so bad I had a battle for him just to sign the papers, we were married for 13 years, Now that my son is Diabled he will need care forever when he turnes 17 I can apply for SSI for him, so that will help but I would really like to make his life miserable as he has made mine, first of all I want to re instate my Sons CS, that was really stupid of me to stop that, because all he thinks about is himself as he always has. so what recourse do I have to re- open the Divorce Decree and would it even be worth the time or effort to do this, and I am sick and tired of him telling me that will have to re pay Social Security Back, and all the insurance he paid over the years.. please help with some advice.. It is too late to be able to ask for the pension, retirement or spousal support. The only time you could have asked for that was during the divorce.

However, you can file for a modification to reinstate the CS order.

If your son is disabled, you might be able to get SSI for him, caontact the SSA to find out what you need to do for that.
