View Full Version : Unemployment Benefits Denied- Please Help Pennsylvania

My wife was fired from her job as a pharmacy technician. One day this month she forgot to pay for a trial version of aspirin & when confronted she offered to pay for it on the spot. It was a honest mistake.They said the reason was because they thought she was stealing pharmacy drugs from the pharmacy safe and that they had been tracking the stolen pharmacy drugs for awhile. For our benefit they would just put on the form it was because she took the aspirin that way the DEA wouldn't get involved.
So we applied for unemployment and got back a letter today saying she was denied because of a dishonest act being the aspirin.
Under these circumstances should we file an appeal? Technically they are right she took the aspirin and admitted it but, that's really not the reason they let her go.
She has said since she got fired. She's seen people including the main pharmacist get something without paying for it but, nothing has ever happened to them.
I want to appeal them just to show them they are wrong. She worked hard at that job never missing a day of work. Just going another 2 months without a paycheck seems daunting.
I've tried to explain this the best I can it is a weird and unusual circumstance. That's another reason i'm not sure what they would say at an appeal. heh if she had taken those drugs they claim she did none of this would matter because they were worth a fortune.
Please advise if anybody has any helpful info.

There is no downside that I can think of to appealing. But it is your wife's decision to make - not mine, and not yours.

No she wants to also. I was wondering if we had a shot at winning the appeal. Also if it's wise to get a lawyer. Not sure if a lawyer helps or hurts the situation.

Lawyers are expensive if you expect them to appear. However, it wouldn't hurt to get a brief consultation with one to discuss how best to present the appeal. You can contact your county Bar Association's Lawyer Referral Service. You might even get one who will do a short telephone conversation for free (I got that in MD when I had to prepare an appeal).
