View Full Version : My daughters mom won't let me see my daughter North Carolina

My daughter who is 6 lives with her mother in NC. Her mom and I never married for very good reasons and I was deployed over seas in the Navy. My daughter was almost 1yr old when this happened. I was deployed for almost 3 yrs and had no contact with her almost the entire time. That was because she moved and told my daughter that I was dead! yes it is true I have a tape recording. Well even though I was dead and there was no custody or child support paperwork I paid child support and maintained her medical insurance(my daughters). she is almost covered 100% by my medical there is a small co-pay of I think $20. While I was over seas she filed with the NC child support enforcement that I was not paying support. Well lets just say that didn't go in her favor. Yes we separated on bad terms. I'm now state side and I finally saw her for the first time i what seemed forever. SHE STILL KNEW I WAS HER DAD! Now mom will not answer my calls. To add to that I get a collections notice in the mail saying i owe over 1000 dollars in back medical bills that she never filed with tricare. They are over a year old. I have the prove she knows how to use tricare and has used it in the passed. I am going to take it to JAG office but I think they are going to take a while if they can do anything besides give me legal advise.

I NEED HELP! I have no idea on what to do to get visitation while I'm out of state and to keep her from doing what she does. AM I liable and can I get something from the court stating visitation. I don't have alot of money for an attorney or travel and with going in and out at anytime on deployments it is killing me!

You need to file for a visitation order. The JAG office may be able to assist you. Unfortunately, until you have a court order, your ex can legally refuse to allow you to visit.

Thanks I kind of figured that would be the case. I have an appointment with the JAG office next week. Any idea if she can fail to use the medical insurance and stick me with the bill? I contacted abc pediatrics when the mom told me they would not see my daughter anymore. That is when I found out she had not given them my tricare information for them to file for over 2 yrs. I got tricare to cover the bills from a 1yr back but they will not cover the billing beyond that. The total is $1082. They have now sent me the collection notice for bills that are over 2 yrs old. The fact that I only knew about them 2 months ago and they have sent it to collections is to not very ethical. Any suggestions on that?

You can bring that issue up in court and let the Judge decide about the medical bills.

The part about the medical bills.......... your JAG officer should definately be able to help you with that if you were deployed during the period that you were billed. They may not be able to keep the medical provider from billing you, but they can protect your credit and prevent any interest from being added during the time you were deployed, etc. There are laws to protect you during deployment.
