OK, some let me start from the beginning, I got divorced 4 years ago from a greedy, greedy, woman. Let me just explain, when we got divorced she asked for $10,000 for every month we were married just to have. We didn't even make that much together a month. Now every time a new woman comes in the picture she starts getting court fever. Well I finally found the right one that won't get chased away and I need help!!! My girlfriend has really made me thing alot and I am really needing help. First off I am in the worst time of my life ever, and I need legal help to save me. Im not one of those guys that doesn't want to pay or doesn't care about there kid. I love my son and I would perfer to take care of him full time. His mother is very secretive and very manipulative. The Lawyer I have is not very helpful at all and charges for every move. My ex took me back for child support recently because I didnt have a job. I was making $20 an hour for almost 7 years
then the job lost the contract so we were forced to quit. I had to find a new job and am now at $9 an hour. While I was making $20 an hour the courts found that I needed to pay $524 a month, then I lost my job so my lawyer put in for a decrease. well I lost my job Feb of 08 and here it is march of 09 and the decrease was put in in NOV. The case for the decrease has been continued 3 times because she has not brought in the paper work that my lawyer subpoenaed her for. She is bringing in paper work from 06 and 07 tax years. She has since had a new kid and living with the new daddy for the four years. The kid is a year old. That I think is a big reason to why she won't bring in the right info.

Here are my questions....
Can't she be held in contempt for not bringing the correct paperwork?
How do I find a lawyer that is as serious as I am at an affordable rate?
Don't the courts have to take her new kid into consideration?
If my girlfriend and I get married, will they use both of our incomes for child support?
With her having a kid with someone else, and I can show proof they live together, do they have to use both of their incomes?

If your attorney has subpoenaed the documents and she has refused, he needs to file a motion for contempt.

It's very difficult to find a low cost attorney. Whay you can do though is to learn about the laws, so that you can assist your attorney.

You didn't say what state the order is in, some states allow a deduction for other children, some don't.

No, if you get married, the court cannot use your spouse's income to determine CS amount. Same for your ex. The only incomes that are used are yours and hers.

NC has a worksheet that is on their web site. You can fill out this worksheet with your income and the mothers income and see what you can expect in court.

You may need to sign up with your MPI # or social security number, to gain access to your child support account and these worksheets. It's simple to do, and allows you easy tracking of child support payments, as well as keeping a record of what you've paid in right there accessible for you.

There is a listing for "other children" that the parent is responsible for...... how this works is that if you had another child for whom you are responsible, it gives you a credit (very small) for having additional children to care for. In other words if YOU had another child it might decrease your child support responsibility (very slightly) and if SHE has another child, it decreases HER responsibility.

NC child support is figured on a percentage basis - on how much percentage each parent should have to provide financially for the child. So, each factor on the worksheet can increase or decrease the parents percentage.

The only reason a new spouses income would ever be placed on that worksheet, is to figure the parents responsibility for the OTHER child (the one not being calculated). In other words if Mom was providing very little of the income for her OTHER child (her spouse was providing for it) then her "credit" for having to financially care for another child may not amount to much.

I'm hoping I didn't just confuse you more. It's kind of complicated. But, the online worksheet calculates everything for you - all you do is plug in the numbers it asks for and it will calculate...... you can play around with it and see WHAT IF's.........

Basically, don't worry about her OTHER child. It's not going to impact your child support order much either way. It would be a very slight difference, and it might even be a CREDIT for her, because she's having to split her financial resources for two children, rather than only one.

You mentioned in your post that your child support order was changed in November 08 yet you had filed toward the beginning of the year (there were postponements made by her??) Did your lawyer ask to have the new order backdated to the date you filed ?????
