I have been with the same company for 9 years. I filed for workers comp in 2004 on my left arm. I have cubital tunnel syndrome, like carpal tunnel except in the nerve in my elbow, the funny bone. I was denied 3 days after filing the claim. I filed a new claim on my right arm in 2007 and did not get approved or denied. I pursued through the courts for my left arm and in May 2008, I was finally awarded full compensation and all appeals by the company were turned down. I received the decision in the mail and 2 days later I was suspended from my job for 3 days without pay. Cause was supposedly for job performance. This is the first time I was ever reprimanded by the company. Management told other employees they could not talk to me and I was not to talk to them. I was then coralled behind a wall alone to keep me away from other employees. I filed a complaint with the EEOC and received a right to sue in August 2008. Within 3 days I was suspended for five days with no pay, again supposedly for job performance. November 2008, I received a notice of hearing for workers comp. In the same week the hearing was scheduled, I was suspended for 10 days with no pay, for job performance. I recently received a notice of payable compensation from workers comp for my right arm. I received this on March 13. March 16 I was suspended again for 20 days. Job performance. I filed grievances with my union. None came back favorable. Unfortunately, I cannot prove misrepresentation by the union or force them to help me. My gripe is the company I work for. Considering I have been with the company 9 years this April, and I have never been repriamded for job performance, I see this as retaliation for not dropping the workers comp claims and the EEOC complaint. I fear that the next letter I receive will be the end of my job. Would you consider this retaliation? Is there any advice you can give me as to what my next step should be?
