WE have a new time clock . I work a 40hr week I am Not exempt. time clock automatically Docks 30 minutes For lunch in an 8hr day. even if you work thru it. It also docks 30 min if you work 6 Hrs Then clock out so you work 6 but get paid for 51/2. is this fair or lawful?

Not legal. If you are a non-exempt employee, you must be paid for all time/hrs. worked. You need to inform someone that you are working through your lunch break so you get paid for the time. Meal (or rest) breaks are not required in Az. However; if your employer requires that you take one, you must take one or you can be disciplined up to & including being fired for not doing so. The one thing they can't do is not pay you for the time worked.
If your employer will not pay you for all hours worked, put in a wage claim with the ICA.

Agreed. It is legal to program the system to auto-deduct lunch; however, it not legal to deduct it if you did not take it. Every system has the functionality for a supervisor to delete the auto-lunch and you need to inform your supervisor when you do not take the lunch so he/she can correct the punches.
