View Full Version : Employment allows breaks, but MGR won't give them...

I work in a fairly large retail chain and my shifts are usually a 7 am to 3 pm, or a 2 pm to 10 pm. My employment allows us to have two 15 minute breaks and one 30 minute break if you work a shift of 6.5+ hours. I am a full time manager and am not allowed to take a break if I am the only manager on duty. The past month or so, whenever I work the later shift, the last manager leaves at 4 pm, which means I have to take my one and only break about 1-1.5 hours into my shift. I know there is no la that requires breaks in pennsylvania, but is there anything I can do? It's getting old...

Might I add that on these days, there are about 5 managers on in the morning but all leave before 4 pm.

Not uncommon unfortunately. In CA (my state) while state law requires lunch breaks and does not specify that this applies only to Non-Exempt employees, the regulations that enforce the law apply penalties only to violations related to Non-Exempt employees.

At some point, a bad employer is a bad employer.

Since the law in PA does not require breaks, this is an internal issue only.
